Elaine Charlton - Civil Marriage Celebrant Queensland.

Under Australian Law, you can be married at any time in any place, as long as your celebrant agrees to perform the ceremony. In the Cairns, Queensland, region there are many beautiful locations for weddings including the Great Barrier Reef, coral atolls, cays, islands, beaches, and the rainforest. We also have a wonderful range of chapels, resorts and private hideaways that are perfect for your intimate and memorable ceremony.
A Summary of Legal Obligations.
  • Both parties to the marriage must be over the age of 18 years. If you are not yet 18, please contact me to discuss your specific situation.
  • A Notice of Intended Marriage (NOIM) must be lodged with me not less than one clear calendar month prior to the date for the ceremony. For example, if you wished to be married on October 18th  2008, your NOIM would need to reach me by no later than September 17th 2008. There are circumstances whereby a couple can apply to a prescribed authority to have this time shortened – please contact me to discuss this. Once lodged with the Celebrant a NOIM is valid for 18 months. Download the NOIM Form
    •  If you are completing your NOIM outside Cairns but within Australia it must be signed in the presence of and witnessed by a JP, solicitor or barrister, a medical practitioner, or a police officer.
    • If you are completing your NOIM outside Australia it must be signed in the presence of and witnessed by a notary public or an Australian Diplomatic Officer or Consular Officer – contact your nearest Australian Embassy for details
  • You must present your original Birth Certificates prior to your marriage taking place. For couples from overseas a current passport is an acceptable form of identification.
  • If either party to the marriage has been married before, you will need to provide evidence as to how that relationship ended; either a Certificate of Divorce (Decree Absolute) or a Death Certificate.
  • There must be two witnesses to the marriage – this can be anyone at all, the only requirement being that they are over the age of 18. To put it simply, there must be five people at the wedding – the couple, the celebrant and two witnesses.
